1. Introduction

Welcome to ECITIZEN e-money issuing service. These Terms and Conditions govern your use of our platform, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and Conditions.

2. Definitions

"Account" means your registered account with us.
"E-money" means electronic money issued by us representing a claim against us.
"Service" means all services provided by us through our platform and applications.
"Transaction" means any operation performed with your e-money account.
"User", "you", "your" refers to the individual or entity using our Service.

3. Account Registration and Use

3.1 To use our Service, you must register an account and provide accurate, complete information.
3.2 You are responsible for maintaining the confidentiality of your account credentials.
3.3 You must notify us immediately of any unauthorized use of your account.
3.4 We reserve the right to suspend or terminate accounts that violate these Terms.

4. E-Money Services

4.1 Our Service allows you to store, transfer, and receive e-money.
4.2 E-money is issued upon receipt of funds and does not constitute a deposit.
4.3 E-money accounts do not earn interest.
4.4 We may impose transaction limits for security and regulatory purposes.

5. Fees

5.1 We charge fees for certain transactions as specified in our Fee Schedule.
5.2 Fees are subject to change with reasonable notice.

6. Prohibited Activities

You may not use our Service to:

• Violate any applicable laws or regulations
• Engage in fraudulent activities
• Conduct money laundering or terrorist financing
• Harass, abuse, or harm another person
• Infringe upon intellectual property rights
• Attempt to gain unauthorized access to our systems

7. Liability Limitations

7.1 Our Service is provided "as is" without warranties of any kind.
7.2 We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
7.3 Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.

8.2 Your continued use of the Service after such changes constitutes acceptance of the new Terms.

9.1 You may terminate your account at any time by following the instructions on our platform.

10. E-Money Issuer

10.1 ECITIZEN is the issuer of e-money through this platform.
10.2 E-money issuance is regulated in accordance with applicable laws and regulations.
10.3 ECITIZEN maintains appropriate safeguards and controls as required by regulatory authorities.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
